TRUSTS & ESTATES

  We can help you plan your estate. This entails: 1) creating a last will and testament, 2) a living will to spell out your wishes ahead of time should you become incapacitated and 3) creating a Power of Attorney (“POA”) to allow a trusted individual to act for you should you need help and to avoid the costs of a court appointed Guardian ad litem. Other issues can include Medicaid trusts and tax issues as needed. We also work with financial planners to give you the best depth over these broad issues.

We can also assist you with in court administration of Estates. Estate administration can entail going to court for both probate and non-probate (intestate) administration, where either a last will is presented to the court verification (the word “probate” comes from Latin and means “to Prove”) or the property of the decedent is parceled out to relatives pursuant to a set of intestate laws where there is no last will.

Estate litigation involves claims by beneficiaries, distributees, and legatees to the real and personal property in an estate of a friend or relative based upon a belief that they are not obtaining their fair share. Such claims can involve a disinherited spouse claiming an elective share, or a dispute over which last will is genuine, to whether there was undue influence over the decedent that interfered with their natural testamentary plan.

REAL ESTATE LITIGATION

 We recently litigated and won Bianchi v Ladgen, see at

 We won summary judgment at the trial court level and then on the Appellate level. This case helps define when a real estate closing takes place when and if funds do not clear by the appointed closing time, and how the risk of loss is apportioned amoungst buyers and sellers.
